The Brazilian Radio and Television Association (Abratel) filed today, 17, at Anatel, petition on the Claro / Fox case. In the document, he argues that the Value Added Service (SVA) must follow the rules applied to traditional pay TV by the Law of the Access Access Service (SeAC).
In focus, the association wants streaming sites, such as Netflix, Amazon Prime Video, Globoplay, to comply with regulatory charges and legal obligations imposed on pay TV. Among them, especially the quotas for serving national content and also the loading of open channels in streaming. IS the case of Record and RedeTV and other Globo competitors that are associated with the entity.
The demonstration refers to the complaint made by Claro against Fox Latin American Channels for having made 11 channels of audiovisual content available to the public through the application FOX + , without the intermediation of a telecom operator.
“We have in the present case that the provision of linear channels by streaming is equal to everything offered by the providers of the Conditional Access Service, however, while the latter have to comply with obligations provided for in Law 12.485 / 2011 [Lei do SeAC], internet companies would not have any of the obligations provided for in the aforementioned law ”, compares Abratel.
According to the organization, the National Telecommunications Agency (Anatel) must deny Fox’s claim, which triggered a discussion on the topic at Anatel and the National Congress. Provoked by Claro, Anatel issued a preliminary injunction prohibiting the offer of linear channels on Fox +, but the company obtained an injunction at the Federal Regional Court of the 1st Region, in Brasília, which allows it to maintain the service offer via subscription.
For this reason, Abratel also wants to discuss the impact of the availability of linear audiovisual content by a new technology on Brazilian companies that offer services already consolidated and with established legal framework. He also wants Claro’s complaint to be discussed by the National Cinema Agency (Ancine).
